Open source vs closed LLM: Regulate only Open Source LLM, AI?

Should we regulate open-source LLM /AI stronger than closed source LLMs (ChatGPT or GPT-4)? Since open source is just from a university and not from META? Should we limit open source LLMs to low-risk applications, and leave the main market only to the global corporations (Microsoft, Google, AWS)? Why would US Congress start to think in this direction?
